  • Legal effects of the ecological emergency declarations: the duty of legal ecoinnovation for the protection of future generations

From the second decade of the twenty-first century onwards, the official, generalized and global recognition of the climate and environmental urgency that unfolds from the ecological crisis, requires the adoption of the principle of innovation as a rule. Innovation can happen at the scientific, technological, social and economic level. In the Anthropocene, law must play the role of lever of the other innovations and no longer be an obstacle to innovations that are fundamental for the transition to more sustainable development models.

But innovation can also happen at the legal level. Legal ecoinnovations are fundamental for a more effective restorative law for intergenerational equity.
